These Terms of Service (“Terms”) govern your access to and use of Focus & Hold (the “App”), provided by Roderick Kar (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms.
1. App Description
Focus & Hold is an Apple Watch and iPhone app for focus timers, isometric hold workouts, workout history, Apple Health integration, and optional calendar logging.
The App is provided for productivity, fitness, and general wellness purposes. It is not a medical device and does not provide medical advice.
2. Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with a parent or guardian’s consent.
3. Health and Fitness Disclaimer
Exercise involves risk. Isometric holds such as wall sits, squat holds, planks, and calf raises may not be suitable for everyone.
You are responsible for deciding whether the App and any exercise performed with it are appropriate for your health, fitness level, and circumstances. Stop exercising if you feel pain, dizziness, shortness of breath, or other concerning symptoms. Consult a qualified healthcare professional before starting or changing an exercise routine, especially if you have a medical condition, injury, or other health concern.
The App’s heart rate display and workout summaries are for general fitness feedback only and should not be used for diagnosis, treatment, or medical decision-making.
4. No Accounts
Focus & Hold does not require a user account. You are responsible for your own device security and for managing access to your Apple Watch, iPhone, Apple Health, and calendar.
5. Payments
Focus & Hold may be sold through the App Store as a paid app.
Payments, refunds, family sharing, purchase history, taxes, and related billing matters are handled by Apple under Apple’s applicable terms and policies. We do not process or store your full payment card details.
Unless required by law or Apple’s policies, purchases are non-refundable.
6. Apple Health and Calendar Permissions
The App may request permission to access Apple Health and your calendar.
HealthKit permissions allow the App to read workout-related data such as heart rate and energy data, and to write completed workouts to Apple Health. Calendar permission allows the iPhone companion app to add completed focus and workout sessions to your own calendar.
You may grant, deny, or revoke these permissions using Apple’s system settings. Some App features may be unavailable or limited if permissions are denied or revoked.
7. Acceptable Use
You agree not to misuse the App, including but not limited to:
- Violating applicable laws or regulations
- Infringing the rights of others
- Attempting to reverse engineer, tamper with, or disrupt the App except where legally permitted
- Using the App in a way that could cause harm to yourself or others
- Using the App for medical diagnosis, treatment, emergency response, or other medical purposes
8. Third-Party Services
The App relies on Apple platform services, including Apple Health, HealthKit, EventKit, WatchConnectivity, notifications, and the App Store. Apple’s terms and policies may apply to your use of those services.
9. App Availability and Changes
We may update, modify, suspend, or discontinue features of the App at any time. Some features depend on Apple hardware, operating system support, permissions, and device availability.
10. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not warrant that the App will be uninterrupted, error-free, or suitable for your particular needs.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, health outcomes, fitness outcomes, or business opportunities arising from or related to your use of the App.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and, where appropriate, provide additional notice. Continued use of the App after changes means you accept the updated Terms.
